vicOta Daily Terms of Use

These Terms of Use ("Terms") govern your use of the vicOta Daily app at app.imvicota.com and its related emails and notifications (the "App"), operated by EliteM AI Inc., the company behind the vicOta brand ("vicOta", "we", "us"). By signing in to or using the App, you agree to these Terms and to the vicOta Daily Privacy Policy. Purchases on imvicota.com are governed by our store Terms of Service.
1. Who can use the App
The App is available by invitation to adults 18 and older. You agree to give accurate information, keep your sign-in secure and use only your own account. You are responsible for activity on your account.
2. What the App does
The App helps you follow a 90-day vicOta routine: log when you take vicOta, check in on how you feel, see your own trends, learn, and, if you choose, record your story. Access to the App is free. We may change, pause or end features or the program at any time.
3. Not medical advice
The App, its content and any feedback in it, including feedback produced with the help of AI, are for general information and personal tracking only. They are not medical advice, diagnosis or treatment, and the App is not a medical device. Talk to your doctor before starting any dietary supplement, especially if you are pregnant, nursing, taking medication or have a medical condition. Stop using vicOta and contact your doctor if you have any concerns. If you think you may have a medical emergency, call your doctor or 911 right away.
Your results are personal and individual results may vary. The trends in the App reflect only what you entered and are not a scientific or clinical measurement.

4. Your content
You own what you put into the App, such as check-ins, notes, photos and videos ("Your Content"). You give us a limited license to store, process and display Your Content to run the App for you, to give you feedback and to improve the App as described in the Privacy Policy.
We will use your testimonial, name, image, voice or likeness publicly only if you sign the separate release in the App's story studio. That release, including the disclosure that you received vicOta free of charge where that applies, governs that use. If you share a testimonial, it must be your own honest experience.
5. Acceptable use
Do not misuse the App. For example, do not access other people's accounts or data, upload content that is unlawful, harmful or not yours, interfere with the App's security or operation, or use the App to collect information about others.
6. Reminders and messages
With your choice of settings, we send reminders and program updates by email and, if you allow it, push notification. You can turn them off in the App or with the unsubscribe link. We may still send messages about your account or these Terms.
7. Third-party services
You sign in with Google, and the App relies on other service providers. Your use of Google sign-in is also subject to Google's terms. We are not responsible for third-party services we do not control.
8. Our content and brand
The App, its design, videos, text and the vicOta name and marks belong to vicOta or its licensors. You may use them only for your personal use of the App.
9. Ending your use
You can stop using the App and delete your data at any time from the Me section or by emailing support@imvicota.com. We may suspend or end your access if you break these Terms or if we end the program. Sections 3, 4 (for testimonials you released), 8, 10, 11 and 12 continue after your access ends.
10. Disclaimers
The App is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App will be uninterrupted or error-free.
11. Limitation of liability
To the extent the law allows, vicOta and EliteM AI Inc. will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of the App. Our total liability for any claim about the App is limited to one hundred US dollars (US$100). Some places do not allow these limits, so they may not apply to you.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise.
13. Changes
We may update these Terms. We will change the date above and, for important changes, tell you in the App or by email. If you keep using the App after a change takes effect, the updated Terms apply.
